  • Communication Data: Records of text (SMS) messages sent as part of normal business operations.

2. Lawful Bases and Purposes for Processing

In accordance with the Data Protection Act, 2019, we process your personal data under the following lawful bases:

Performance of a Contract

We process your data to fulfill our contractual obligations under our Terms of Use, including:

  • Registering and maintaining your active personal user account.
  • Enabling you to arrange, schedule, and execute transportation and logistics services with independent Third Party Providers.
  • Facilitating immediately due charges and payments using your designated payment methods.
  • Sending essential transaction receipts and operational text (SMS) messages.

Legitimate Interests

We process your data to protect our business and operational integrity, including:

  • Verifying your identity to prevent unauthorized access to our systems.
  • Managing promotional codes, account credits, and loyalty benefits.
  • Handling, verifying, and facilitating payments for vehicle repair or cleaning requests reported by Third Party Providers.

Legal Obligations and Dispute Resolution

  • Resolving complaints, conflicts, or disputes (such as transport accidents) involving you and a Third Party Provider by sharing necessary information with claims processors or insurers.
  • Complying with statutory accounting, tax, or regulatory mandates within Kenya.

3. Sharing and Disclosure of Your Data

We do not sell your personal data. However, to deliver our platform services, we may share your data with the following entities:

  • Independent Third Party Providers: Drivers, logistics providers, and transport permit holders to enable them to fulfill your requested transportation and delivery routes.
  • Insurers and Claims Processors: If a complaint, dispute, or accident occurs involving you and a third-party driver, we may disclose your contact details and relevant data to resolve the issue.
  • Subsidiaries and Affiliates: Companies under the Dau Technologies Limited corporate umbrella that assist in providing request options or administrative support.
  • Payment Partners: Mobile money operators (e.g., Safaricom/Mpesa, Airtel Money) and banking systems to securely process your fares and fees.

4. Data Security and Malfunctions

We implement appropriate technical and organizational measures to maintain the security and secrecy of your account usernames and passwords. While we strive to protect your data, please note that electronic transmissions over the internet can be subject to inherent delays or communication malfunctions beyond our reasonable control.

5. Data Retention

We retain your personal information only for as long as necessary to fulfill the purposes for which it was collected, or to comply with legal, regulatory, or internal policy requirements.

Note on Property Retention: If any personal property is left inside a Third Party Provider's vehicle and handed over to our offices, we will take reasonable steps to establish ownership. Such property (and any associated identity logs) will be kept for a maximum period of three months, after which it will be disposed of or dealt with as we deem fit.

As a data subject in Kenya, you possess specific statutory rights regarding your personal data:

  • Right to be Informed: To know how and why your personal data is being processed.
  • Right of Access: To request a copy of the personal data we hold about you.
